TINJAUAN HUKUM ISLAM TERHADAP PRAKTIK MUZARA’AH GARAPAN SAWAH (Studi Kasus di Desa Sukamahi Kecamatan Sukaresmi Kabupaten Cianjur)

This study aims to examine the practice of muzara'ah (sharecropping) in rice fields, focusing on the principles of justice, inhibiting factors, and solutions. The research was conducted in Sukamahi village, Sukaresmi district, Cianjur regency, West Java. Based on phenomenological philosophy, this study focuses on the experiences of farmers and landowners as perceived in their consciousness. Using a qualitative method, this research seeks to obtain holistic data. The results show that the muzara'ah practice in Sukamahi village applies a 50:50 profit-sharing system but requires formulation in the contract to achieve justice. Inhibiting factors include unclear cost-sharing, lack of communication, and profit or loss sharing. Solutions include increasing transparency, creating clear contracts, conducting deliberations, and the role of Islamic financial institutions in financing.
